Terms of Service

Welcome to JobbyJob.ai ("JobbyJob," "we," "us," or "our"), an AI-powered career acceleration platform operated by Manito AI, a company based in the United States. By accessing or using our website, APIs, optional SDKs or browser extensions where offered, mobile apps (which load the live site), or related services (collectively, the "Service"), you agree to these Terms of Service ("Terms"). Please read them carefully. These Terms constitute a binding contract between you and Manito AI; if you do not agree, do not use the Service. These Terms are not legal or professional advice; consult your own advisor for questions specific to your situation.

1. Acceptance and eligibility

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. You represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the authority to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and the organization agrees to these Terms.

2. Service description

JobbyJob.ai is an AI-powered career platform that provides tools and services designed to help job seekers, professionals, and teams manage and advance their careers. The Service includes, but is not limited to:

• Resume 360 – Career profile: upload or connect sources, AI extraction (including vision OCR where used), chat-based refinement, and exports.
• Job Center – Job discovery from integrated sources, job alerts, opportunities, and application tracking.
• Trending – Personalized feeds and industry content; may use engagement signals to improve relevance.
• Site Builder – AI-assisted sites and templates, publishing, and optional custom domains.
• Portfolio, Blog, and Resources – Public-facing content and downloads you configure.
• AI Headshots – AI-generated professional headshots (third-party image provider where applicable).
• Voice Profile and Voice Trainer – Writing-style / voice settings and related practice tools (features may evolve).
• Network (CRM) – Contacts and companies with optional Mesh (me.sh) enrichment when you supply your own Mesh API key, plus imports such as Google or Microsoft contacts, Apple, or CSV where supported.
• Peer Matching – Networking suggestions based on similar professional experience.
• Adaptive Portfolio – AI-assisted tailoring of presentation for specific roles or employers.
• Analytics and Visitors – Traffic and visitor insights for your published pages.
• Billing, credits, teams – Subscriptions, credit packs, free trial, and optional team collaboration.

We may add, modify, or discontinue features of the Service at any time. We will make reasonable efforts to notify users of material changes, but we are not obligated to maintain any particular feature indefinitely.

Beta.JobbyJob.ai is offered on a beta basis: we may ship frequent improvements, fixes, and changes to features or limits. The Service is provided "as is" during this period; see disclaimers below.

3. User accounts and authentication

To use most features of the Service, you must create an account. You may sign up using an email address and password, or through supported third-party authentication providers (such as Google or GitHub OAuth). You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account, whether or not authorized by you.
• Promptly notifying us if you suspect unauthorized access to your account.
• Providing accurate and complete registration information and keeping it up to date.

We reserve the right to suspend or terminate accounts that violate these Terms, that are used for fraudulent purposes, or that have been inactive for an extended period. You may not create multiple accounts to circumvent plan limits, abuse free tiers, or evade enforcement actions. We do not store plain-text passwords; authentication is handled by our infrastructure provider (Supabase).

4. Subscription plans and billing

JobbyJob.ai offers the following subscription tiers (prices are in U.S. dollars and subject to change with notice):

• Starter – $19/month (annual billing may be offered at a discount). Includes a monthly platform credit allowance and plan limits described at checkout and in-product.
• Professional – $49/month (annual billing may be offered at a discount). Higher limits and additional features than Starter.
• Scale – $199/month (annual billing may be offered at a discount). Highest published platform credit allowance (10,000 AI credits/month with rollover), up to 100 sites, up to 25 team members, 1M API requests/month, and unlimited custom domains. Does not entitle the subscriber to uncapped third-party AI/compute usage or unlimited liability for provider costs.
• Enterprise – Custom pricing. Tailored solutions for teams and organizations with dedicated support, custom integrations, and volume licensing.
• Free trial and credit packs – We may offer time-limited trials and one-time credit packs; exact allowances are shown in the product and at checkout.

Payments are processed through Stripe. By subscribing, you authorize Manito AI (via Stripe) to charge your payment method on a recurring basis at the applicable rate. All fees are non-refundable except as required by applicable law or as expressly stated in these Terms. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period. We do not store full credit card numbers; all payment data is handled by Stripe in accordance with PCI DSS requirements. We may offer free trials or promotional pricing; at the end of any trial or promotional period, standard pricing applies unless you cancel before the trial ends. We reserve the right to change pricing with at least 30 days' advance notice; continued use after a price change constitutes acceptance.

5. AI-generated content disclaimer

The Service uses artificial intelligence and machine learning models to generate content, recommendations, analyses, and other outputs ("AI Outputs"). You acknowledge and agree that:

• AI Outputs are generated by automated systems and are not guaranteed to be accurate, complete, current, or error-free.
• AI Outputs (including resume analysis, job matches, interview coaching, and headshots) are for informational and assistive purposes only and should not be relied upon as professional, legal, medical, or financial advice.
• You are solely responsible for reviewing, verifying, and editing any AI-generated content before using it in job applications, professional communications, or any other context.
• AI models may produce outputs that are biased, inaccurate, or inappropriate. We work to minimize these issues but cannot eliminate them entirely.
• We do not warrant that AI-generated headshots will accurately represent your appearance, or that AI-generated resume suggestions will be appropriate for your specific circumstances.
• JobbyJob.ai and Manito AI disclaim all liability for any consequences arising from your reliance on AI Outputs.

6. Bring Your Own Key (BYOK)

JobbyJob.ai supports a Bring Your Own Key (BYOK) feature that allows you to connect your own API keys from supported third-party providers (including OpenAI, Anthropic, Google AI, Mistral, Cohere, Perplexity, Resend, Mesh, and Google Analytics). When using BYOK:

• You are solely responsible for all usage, costs, and charges incurred through your own API keys. JobbyJob.ai does not monitor, limit, or control your third-party API usage beyond what is necessary to operate the Service.
• BYOK usage bypasses platform credit limits and billing; charges are applied directly by the respective third-party provider under their own terms and pricing.
• You are responsible for securing your API keys. We store BYOK secrets encrypted at rest so the Service can use them on your behalf; they are not retained in plain text. Rotate keys regularly and revoke access if compromised.
• Your use of third-party services via BYOK is governed by the respective provider's terms of service and privacy policy. We are not a party to those agreements.
• Mesh (me.sh; formerly marketed as Clay) integration is strictly BYOK; there is no system-wide fallback. You must provide your own Mesh API key under Settings to use Mesh features.
• We are not liable for any damages, costs, data loss, or service disruptions arising from your use of third-party APIs through BYOK, including but not limited to API key leaks, rate limiting, billing disputes, or changes to third-party terms.

7. Acceptable use policy

You may use JobbyJob.ai only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable law, regulation, or third-party rights.
• Infringe any intellectual property, privacy, or publicity rights.
• Transmit harmful, illegal, defamatory, harassing, or offensive content.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
• Scrape, crawl, or use automated means to access the Service without our written permission.
• Resell, sublicense, or commercially exploit the Service or any part thereof in violation of these Terms.
• Abuse AI features to generate excessive, fraudulent, or harmful content.
• Circumvent credit limits, usage quotas, or payment requirements.
• Misuse browser extensions to scrape protected or copyrighted content.
• Use the Service to create fraudulent resumes, fake professional profiles, or misleading representations of qualifications.
• Attempt to gain unauthorized access to other users' accounts, data, or any part of our infrastructure.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Upload viruses, malware, or other harmful code.

We may remove content, suspend, or terminate your access at any time for breach of this acceptable use policy or for any other reason, without prior notice and without liability to you.

8. Your content and our intellectual property

Your content. You retain ownership of all content you submit to the Service (e.g., resumes, profiles, portfolio content, site builder content, AI headshot inputs, voice profiles, job applications, and network contacts). You represent that you have all rights necessary to grant the licenses below. You grant Manito AI a worldwide, non-exclusive, royalty-free license to use, store, copy, and process your content as needed to provide, operate, secure, and improve the Service (including backups, AI processing, and compliance). We do not use your content to train AI models unless we separately disclose and you consent. Templates created with our SDK and submitted to the marketplace are subject to additional marketplace terms.

Our intellectual property. The Service, including its software, design, branding, logos, trademarks, documentation, APIs, and all associated intellectual property, are owned by Manito AI or its licensors. You may not copy, modify, distribute, sell, or lease any part of our intellectual property without our prior written permission. Nothing in these Terms grants you any right to use the JobbyJob or Manito AI name, logos, or trademarks.

9. User data and privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points include:

• We encrypt personally identifiable information (PII) at rest using AES-256-GCM encryption, including resume data, chat history, CRM contacts, and network contact information.
• We do not sell your personal information.
• You may request access to, correction of, or deletion of your personal data through your account settings or by contacting us.
• We comply with applicable data protection laws including GDPR, CCPA/CPRA, and other U.S. state privacy laws.
• When you use BYOK, data sent to third-party providers is governed by their respective privacy policies.

By using the Service, you acknowledge that you have read and understood our Privacy Policy and consent to the practices described therein.

10. Third-party services

The Service relies on third-party providers for authentication (e.g., Supabase), hosting (e.g., Vercel), payments (e.g., Stripe), email (e.g., Resend), storage (e.g., Upstash), AI (e.g., OpenAI, Anthropic, Astria for headshots), lead enrichment (e.g., Mesh when you enable BYOK), corporate visitor identification where used, and analytics or error tracking. Your use of those features may be subject to their terms and privacy policies. If you use BYOK (Bring Your Own Key) for AI services, you are responsible for compliance with those providers' terms. We do not control and are not responsible for third-party services, their availability, accuracy, or conduct. AI outputs and third-party content are not guaranteed, and we disclaim any liability for them.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, MANITO AI AND ITS AFFILIATES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT RESULTS FROM THE SERVICE (INCLUDING AI OUTPUTS, JOB MATCHES, RESUME ANALYSES, OR THIRD-PARTY INTEGRATIONS) WILL BE ACCURATE OR RELIABLE. YOU USE THE SERVICE AT YOUR OWN RISK.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MANITO AI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). WE ARE NOT LIABLE FOR THE ACTS OR OMISSIONS OF THIRD-PARTY PROVIDERS (INCLUDING AUTH, HOSTING, PAYMENTS, EMAIL, AI PROVIDERS), FOR UNAUTHORIZED ACCESS TO YOUR DATA BEYOND OUR REASONABLE CONTROL, FOR COSTS INCURRED THROUGH YOUR OWN API KEYS (BYOK), OR FOR LOSS OF DATA DUE TO YOUR ACTIONS OR THIRD-PARTY FAILURES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

13. Indemnification

You agree to indemnify, defend, and hold harmless Manito AI and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your content; (c) your breach of these Terms; (d) your violation of any law or third-party rights; or (e) your use of third-party APIs through BYOK. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you; you will cooperate with us in defending such claims.

14. Termination

We may suspend or terminate your account or access at any time for breach of these Terms or for any other reason, with or without notice. You may close your account at any time via your account or billing settings. Upon termination:

• Your right to use the Service ends immediately.
• Any active subscription will not be renewed, but we have no obligation to issue a prorated refund for the remainder of any billing period except as required by law.
• We may retain or delete your data as described in our Privacy Policy (including for legal, security, or backup purposes).
• You may request an export of your data prior to account closure; we will make reasonable efforts to provide it in a standard format.
• Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) will remain in effect.

15. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Continued use of the Service after changes constitutes acceptance. For material changes, we may notify you by email or in-app notice where required or appropriate. If you do not agree to the revised Terms, you must stop using the Service and close your account.

16. Governing law and disputes

These Terms are governed by the laws of the United States and the State of Washington, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in Washington, and you consent to personal jurisdiction and venue there. You waive any right to a jury trial and to participate in a class action to the fullest extent permitted by law. Where a court finds any provision unenforceable, the remaining provisions remain in effect.

17. General

These Terms, together with the Privacy Policy and any order or billing terms, constitute the entire agreement between you and Manito AI regarding the Service. Our failure to enforce any right does not waive that right. We may assign these Terms or our rights under them; you may not assign without our prior written consent. We are not liable for any failure or delay due to causes beyond our reasonable control (e.g., acts of God, war, pandemics, strikes, internet or third-party service failures). You represent that you are not located in a country subject to U.S. or other applicable government embargo or designated as supporting prohibited activities, and that you will comply with all applicable export and import laws. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.
